Used Car Purchase Agreement - General Terms & Conditions
This agreement outlines the general terms and conditions between the Buyer and the Seller for the purchase and export of a used motor vehicle.
1. Vehicle Condition:
The vehicle is sold based on the auction report provided. The vehicle is considered 'Sold As Is' with no guarantee of return, refund, or replacement after shipment. The Buyer acknowledges that minor mechanical and cosmetic wear may exist, consistent with a used vehicle.
2. Payment Terms:
The Buyer agrees to pay the initial booking deposit to reserve the vehicle. Full payment must be made within 3-5 working days after the vehicle is confirmed or won in auction. Failure to complete the payment on time may result in cancellation without refund of the deposit.
3. Shipping Terms:
The Seller will arrange shipping from the export port to the destination port. Shipping duration may vary (typically 22-45 days) and delays due to weather, port congestion, or customs are not the responsibility of the Seller.
4. Insurance:
If the deal is CIF (Cost + Insurance + Freight), insurance is included. For FOB or C&F agreements, the Buyer is responsible for arranging insurance.
5. Customs and Clearance:
All customs duties, taxes, port charges, and clearance fees in the destination country are the responsibility of the Buyer. The Seller's responsibility ends once the vehicle is shipped and Bill of Lading is issued.
6. Documentation:
The Seller agrees to provide the Buyer with necessary export documents including:
- Bill of Lading
- Export Certificate
- Commercial Invoice
- Inspection Certificate (if required)
7. Claims and Disputes:
Claims are only accepted if there is a major undisclosed issue that contradicts the auction report. Hidden mechanical failures discovered after arrival are not grounds for claim.
8. Legal Jurisdiction:
Any disputes arising from this agreement shall be resolved under the laws governing the Seller’s country of operation.
By signing below, both parties confirm that they understand and agree to the terms and conditions mentioned above.
